Which states have legalized cannabis?

The cannabis laws in all 50 US states differ. Over 20 states have now legalized cannabis for recreational use, including California, Nevada, Oregon and New York. Other states allow medical cannabis, but not recreational use. Where to see the USA, our interview tip: Cannabis Party USA.

Nationwide legalization debate

Although many states have legalized cannabis, it remains illegal at the federal level. This leads to problems with banking, taxes and interstate commerce. However, there are strong political movements pushing for legalization on a national level.

Differences between the states

Each state has its own rules for purchase, possession and consumption. In California, for example, you are allowed to possess 28.5 grams, in Illinois only 30 grams. Some states allow home cultivation, others do not. In comparison, in Germany you are allowed to possess 50 grams of cannabis, as a patient even 100 grams of medical cannabis.

Cannabis economy in the USA: market, brands & billions

The cannabis industry in the USA is one of the fastest growing sectors. In 2024, the market reached a volume of over 30 billion dollars. Jobs are being created, tax revenues are rising – cannabis is a real economic factor. Legalized states benefit from high tax revenues. California took in over 1.5 billion dollars from cannabis taxes in 2023. These funds flow into schools, infrastructure and social programs.

Challenges for companies

Despite growth, there are hurdles: Banks often deny accounts to cannabis businesses because cannabis remains illegal at the federal level. There is also competition from the black market, which continues to exist.

Laws & rules for delivery services

Each state has its own regulations. In California, cannabis delivery is allowed, but not in Nevada. In some states, you must show your ID upon delivery. The demand for cannabis deliveries is growing. In the future, drones or automated systems could revolutionize the market.

From medicinal plant to ban (before 1930) – Fact #1

Before prohibition, cannabis was widely used in the USA. It was sold in pharmacies and was a popular remedy for pain, insomnia and inflammation. The hemp industry flourished, especially for the production of rope, textiles and paper.

Cannabis Prohibition (1930-1990) – Fact #2

In the 1930s, the anti-cannabis campaign began, driven by racist and economic motives. The Marihuana Tax Act of 1937 criminalized cannabis, and with Richard Nixon’s War on Drugs in the 1970s, the fight against cannabis intensified. Millions of people – especially minorities – were arrested for cannabis possession.

The first steps towards legalization (1990-2010) – Fact #3

California was the first state to legalize medical cannabis in 1996. Other states followed suit, but cannabis remained illegal at the federal level. Despite strict laws, public support for legalization grew.

Legalize! Colorado and Washington legalize (2012) – Fact #4 (won!)

In 2012, Colorado and Washington voted for the full legalization of cannabis – a milestone. This opened the door for other states to gradually pass their own laws.
