Bavaria’s clubs facing the end? Costs instead of cannabis

“Bayerns Club vor dem Aus” – What’s going on with the legalization of cannabis in Bavaria? We watched the latest documentary from Bayerischer Rundfunk, which takes you on a journey through hope, setbacks and fighting spirit. It’s about the Cannabis Social Club Minga, which wanted to fulfill its dream of growing cannabis legally. But the road there is rockier than you might think.

The big dream: growing legally in Bavaria

Just imagine: Not far from Munich, a 450 square meter hall that has been perfectly prepared for the cultivation of medical cannabis. Electronics installed, requirements fulfilled, concepts thought through – everything ready for a new start. This is exactly what the Cannabis Social Club Minga set out to do. The club not only wanted to provide its members with a safe, legal supply, but also to be a pioneer for cannabis legalization in Bavaria.

Perhaps you know the feeling of planning something big and then waiting hopefully for everything to work out. That’s exactly how it was for the club members who submitted their application back in the summer. But what followed was anything but the breakthrough they had hoped for.

The authorities: Hope meets resistance

In the documentary, you can see how the joy of being able to grow cannabis legally quickly turns into frustration. In November, the answer finally came from the State Office for Health and Food Safety(LGL). But instead of a permit, there were objections to the association’s statutes. The reason? According to the Consumer Cannabis Act, all members must “personally participate”. Sounds sensible at first, doesn’t it?

But now imagine you are a member of a club and cannot actively work with your hands for health reasons. Should you be excluded because of this? This is exactly where the problem lies: the association interprets the law in such a way that all members can contribute to the process in some way – be it through planning, documentation or other organizational activities. The authorities see it differently and reject the application. A major setback for the club.

Not only in Bavaria, but also Cannabis Social Club in Berlin are at their limit due to the bureaucracy.

You ask yourself: What does “personal involvement” mean?

The big issue revolves precisely around this wording in the law. You can imagine how frustrating this is for the association, which wants to live inclusion and equality. Disabled members or people with disabilities should not be excluded just because they are physically unable to work directly with the plant. But that is exactly what the strict interpretation of the law would mean. A clear contradiction to fundamental rights.

Even the Bavarian state government’s commissioner for the disabled confirms this in the documentary: The narrow interpretation of the law puts people with disabilities at a disadvantage. For you, this shows once again how difficult the legalization of cannabis is in practice in Germany – especially in Bavaria, where the state government shows little enthusiasm for legalization anyway.

The costs: What’s behind the dream?

You may have wondered how much effort and money goes into a project like this.

The club has already invested over 25,000 euros in converting the hall and complying with all regulations. In addition, there are rental costs of around 2,000 euros per month.

And all this for a dream that has now been shattered for the time being. You can imagine how disappointed the members are.

What happens next? The fight for justice

Now comes the exciting part: the club won’t give up!

Perhaps this will inspire you to stand up for your own convictions. The association has filed a complaint against the president of the LGL and is preparing a lawsuit. They are not only concerned about their permit, but also about setting a precedent. This could help other cannabis social clubs in Bavaria that are also waiting for their permits.

In the documentary, you can see how the members are determined to fight on. They want to prove that they meet the legal requirements and at the same time stand up for equal rights. The case of the Cannabis Social Club Minga could have far-reaching consequences for the legalization of cannabis in Germany.

The problem: Bavaria and legalization

You probably know that Bavaria goes its own way on many political issues – and that also applies to the legalization of cannabis. The state government has already announced that it will apply the law as restrictively as possible. For clubs like CSC Minga, this means a rocky road with unclear prospects of success. But this is precisely what makes the case so important: it will decide how much leeway the states actually have in implementing the Consumption Cannabis Act.

Why should you be interested?

Perhaps you are asking yourself: What does this have to do with you? Quite simply, the case shows how complex the legalization of cannabis in Germany is – and how important it is that everyone involved is treated fairly. If you are considering joining a cannabis social club or campaigning for legalization yourself, you should be aware of the challenges such clubs face.

The documentary: A look behind the scenes

The documentary from Bayerischer Rundfunk shows you not only the facts, but also the emotions of those involved. You see how much heart and soul the members put into their association and how they continue to fight despite all the setbacks.
